Turkish citizenship decision 2021

  • Investors in Turkey face many problems during their journey to own a property and acquire citizenship.
  • The Ministry of Environment and Urban Survey has amended the decision to acquire Turkish citizenship through ownership.
  • The new amendment is in line with the interests of foreign investors and those wishing to reside permanently.

Some of the most important amendments and additions made by the Ministry of Environment and Urban Survey:

All properties qualify you for citizenship.

  • The Ministry of Environment and Urban Survey has made some modifications and additions:
  • If the land is residential
  1. The owner must undertake a construction project and obtain the necessary licenses within two years.
  2. The owner must pledge not to sell the plot within 3 years.
  3. The land area should not exceed 30 hectares.
  • If the land is agricultural
  1. The owner must undertake an agricultural project and obtain the necessary licenses within two years.
  2. The owner must pledge not to sell the plot within 3 years.
  3. The land area should not exceed 30 hectares.

Turkish title and Turkish citizenship

  • After the new amendment, a sales contract cannot be regulated by the notary without a title deed.
  • There are two types of the title deed for the apartment (kat mülkiyeti) or a title deed for the plot (kat irtifakı).
  • The owner must pledge to the notary and property management not to sell the apartment for 3 years.
  • The purpose of this amendment is to limit the frauds that have occurred that can occur through the pledge process.
  • A problem that enables more than one person to buy the same apartment in the absence of a title deed that has finally been solved.

Title deed or sale contract

  • According to the law of ownership and citizenship, there is no specific number of apartments to own.
  • It is enough to have a minimum of 250,000$ resulting from the apartments.
  • In the previous law, apartments are supposed to be sold either by managing property ownership or through a sales contract with the notary.
  • It was not permissible to have a title deed for an apartment and a sales contract for another apartment, which is now possible.

Proof of property value

  • If the value of the property is equivalent to 250,000$ or not, the bank’s notice will be taken into account.
  • If the investor sends the hawala in dollars, it is only sufficient to show the bank’s notice signed or stamped by the bank.
  • When sending a hawala in Turkish lira, the exchange rate will be looked at one day before the date of transmission.
  • The Central Bank of Turkey determines the exchange rate and the total must be 250,000$.
  • When purchasing a property through a state-owned company, the owner only obtains a payment statement from the company.

Extend the evaluation of the drug for a longer period

  • The evaluation report of the drug is valid for 3 months from the date of its issuance, while it is valid for one or two days.

Date of receipt of title deed and date of issuance of citizenship law

  • For properties purchased before 19/09/2018 and received their title deed after this date, they are entitled to benefit from the Citizenship Act for 250,000$.
  • If the title deed is taken before 19/09/2018, the owner is entitled to benefit from the sexual law, but in the amount of 1,000,000$.

The last owner.

  • It is now possible to buy the property and benefit from the citizenship law if the last owner of the property is of Turkish origin.
  • Previously it was possible to benefit from the citizenship law when the last three-third of owners of the property were of Turkish origin.
  • You cannot obtain citizenship when you buy a property from a person with citizenship through ownership or bank deposit.
  • You cannot benefit from the citizenship law if you have purchased a property from a foreign person.
